Preamble

The Client acknowledges that the service is provided by ANDREA LA MARTINA LTD via the Internet and therefore in the manner described online and published on the website www.lamartina.net, under the conditions set out below.

The online transmission of the request form for service activation and payment of the required fee constitutes full acceptance of the general terms and conditions of this contract. Any additional services beyond those specified in the offer may be provided only upon specific request by the User, according to arrangements to be defined from time to time.


1. Definition of the Parties

This service supply contract is entered into between the company ANDREA LA MARTINA LTD, owner of the domain www.lamartina.net, with registered office at 71–75 Shelton Street, Covent Garden, London WC2H 9JQ, United Kingdom, hereinafter simply referred to as "La Martina," and the User as the subscriber of the contract or subscription form, hereinafter simply referred to as "User."


2. Description of the Service

La Martina provides the User with digital and consulting services accessible via the Internet telecommunications network, through computers permanently connected to it.

The User, acting in complete autonomy, may purchase the services offered by La Martina. La Martina will provide its professional services through its own systems connected to the Internet.

For legal, business, or financial purposes, the User using La Martina's services must be considered an entity independent from La Martina. The User has no authority to act in the name and on behalf of La Martina.


3. Purpose of the Contract

By signing the order on the website www.lamartina.net and sending it to La Martina, the User requests La Martina to provide its services according to the characteristics indicated in the order itself. Signing the order and using the services implies acceptance of these general terms and conditions.

The User acknowledges and agrees that:

  • La Martina undertakes an obligation of means and not of result; therefore, the success of the request depends on the User's cooperation
  • For the service delivery process to be successful, the user must provide correct and truthful data
  • La Martina undertakes to send all necessary instructions and information to complete the requested operation to the email address provided by the User
  • The User must notify La Martina immediately or no later than 24 hours of any irregularities in the service

4. Payment and Non-Payment

The contract is concluded only when La Martina receives from the user the service activation request form, fully accepted in every part, following the procedures provided for online contract conclusion, together with payment of the fee for the chosen service type.

The service activation starts from the date payment is made. Payment for the first period must be made at the time of service activation, while for subsequent periods, payment must be made within 15 days of the expiry date.

La Martina reserves the right to unilaterally change both the rates and the terms and conditions of this agreement at any time and without notice. The dissenting User has the right to withdraw from the subscription within 30 days of becoming aware of any change.


5. Duration

The contract lasts for the period indicated in the order and is considered tacitly renewed by the user at expiry unless notice of termination is given by registered letter at least 30 days before the end of the current period.

30-Day "Satisfaction or Refund" Guarantee

All our services are covered by a 30-day "Satisfaction or Refund" guarantee. If you are not completely satisfied with the service during the first 30 days of use, La Martina will refund the cost of the plan, with no need to justify the reason for the request.

The Client may freely withdraw from these Terms within 30 days of concluding the relevant contract. The withdrawal must be exercised by written communication sent by registered letter with return receipt to La Martina or via email to privacy@lamartina.net.

Excluded from the refund:

  • Any activation fees incurred (setup costs)
  • Banking and/or credit card transaction fees
  • Services already fully provided
  • Additional services already used

6. User’s Obligations, Prohibitions, and Liability

La Martina is not responsible for the content of the information published by the user and shall not be held liable in any way for any direct or indirect damages caused by the services provided. The User uses the services made available by La Martina, assuming all civil and criminal liability arising from their use.

It is strictly PROHIBITED to use the services for:

  • Illegal purposes
  • Sending unsolicited advertising (spam)
  • Pornographic, obscene, or offensive material
  • Material for purposes contrary to public order
  • Material infringing the rights of third parties
  • Material protected by copyright without authorization
  • Material illegally possessed

The User undertakes not to store sensitive data and to take responsibility for any consequences arising from the failure to protect entered data. The User also agrees to take the utmost care with the alphanumeric codes (passwords) necessary for the service’s execution.


7. Limitation of Liability

Under no circumstances shall La Martina, nor anyone involved in the creation, production, or delivery of La Martina's services, be held liable for any direct or indirect damage of any kind arising from the activation or use of the services.

La Martina shall not be held liable for failures caused by events beyond its foreseeable control or due to force majeure.

No compensation for damages may be claimed from La Martina for direct and/or indirect damages caused by the use or inability to use the services. If the user suffers damages, only the refund of the price paid for the unused period of service may be requested.


8. Force Majeure

Neither party shall be held responsible for failures due to fire, explosion, earthquake, volcanic eruptions, landslides, cyclones, storms, floods, hurricanes, avalanches, war, civil unrest, riots, strikes, or any other unforeseeable and exceptional cause preventing the provision of the agreed service.


9. La Martina’s Obligations

La Martina undertakes to maintain the efficiency of the service offered: if forced to interrupt the service due to exceptional events or maintenance, La Martina will restore services as quickly as possible to minimize any inconvenience.

La Martina will define appropriate service access procedures and reserves the right to improve them at any time to increase efficiency. La Martina will provide the client with all technical specifications required to access the services.


10. Personal Data Processing

La Martina will collect and store the personal data from the subscription form for the purpose of fulfilling tax obligations and any other needs related to the activation, management, and/or maintenance of the services provided.

The personal data provided by the User to La Martina, directly or indirectly, are protected under EU Regulation 2016/679 (GDPR) and current personal data protection legislation, and will therefore be used solely for the complete execution of the contract and legal obligations.

11. Suspension/Termination of Services

The Client agrees that La Martina may suspend services without notice and without liability if:

  • La Martina reasonably believes that the services are being used in violation of the rules of conduct
  • The Client does not cooperate with investigations into any suspected violations of the rules
  • La Martina believes that service suspension is necessary to protect its business or other clients
  • As required by law enforcement or authorized agencies

12. Termination Clause

La Martina reserves the right to declare the contract terminated by simple written communication sent via email in cases of non-fulfilment of obligations regarding payment and User obligations, without prejudice to La Martina's right to receive payment for the contracted services even if not fully used.


13. Jurisdiction

For any dispute arising from or related to the application of this contract, the parties agree to the jurisdiction of the Court of London, England, in accordance with the laws of the United Kingdom.


14. Complaint Procedures

Any complaints regarding any aspect of the contractual relationship and/or service provision must be sent to La Martina in writing within 8 days of the reason occurring.

La Martina will review the complaint and respond to the client within 5 days of receipt. In the case of particularly complex complaints, La Martina will inform the Client within the above timeframes about the status of the case.


15. Final Provisions

This agreement may only be amended by a formal written agreement signed by both parties. The absence or delay in enforcing any provision of the Contract shall not be considered a waiver of rights regarding such provision.

This agreement, together with the order, constitutes the complete and exclusive agreement between the parties concerning its subject matter and supersedes any prior written or oral understanding or communication.
